(b) Pursuant to s 77 of the Civil Procedure Act 2005, the amount payable by the Defendant to the Plaintiff be paid to the NSW Trustee and Guardian. (c) The proceedings be adjourned to the Registrar's List at 9:00 a.m. on 28 May 2012 but if the amount to be paid is paid by the Defendant to the NSW Trustee and Guardian as required, there may be filed in the Registry Short Minutes an order dismissing the proceedings with no order as to costs and vacating the date to which the matter has been adjourned.
