Judgment 1COMMISSIONER: This is an appeal pursuant to the provisions of s 97 of the Environmental Planning and Assessment Act 1979 against the refusal of Development Application No. D/12/462 (the proposal) by the Council of the City of Sydney (the Council) to construct a five storey residential flat building with retail on the ground floor fronting Riley Street, at 43-45 Riley Street, Woolloomooloo (the site).
