(2) Set aside the orders made by Delaney DCJ dismissing the respondent's Notice of Motion and ordering that the costs of the Motion be costs in the cause. (3) Order pursuant to r 14.28 of the Uniform Civil Procedure Rules 2005 that the respondent's Statement of Claim filed in the District Court be struck out. (4) Order the respondent to pay the applicant's costs in the District Court and on appeal. (5) Grant the respondent a certificate under the Suitors' Fund Act 1951, if he is qualified. [Note: The Uniform Civil Procedure Rules 2005 provide (Rule 36.11) that unless the Court otherwise orders, a judgment or order is taken to be entered when it is recorded in the Court's computerised court record system. Setting aside and variation of judgments or orders is dealt with by Rules 36.15, 36.16, 36.17 and 36.18.
