Decision: 1. Appeal allowed in part. 2. Cross-appeal dismissed. 3. Set aside the judgment in favour of the appellant in the sum of $124,938.48 given and entered on 17 October 2011 and in lieu thereof enter judgment for the appellant in the amount to be determined by the parties in accordance with these reasons and conveyed to the Court within 7 days of the date of these orders. 4. The respondent to pay the appellant's costs of the trial before Schmidt J and of the appeal but to have with respect to the latter a certificate under the Suitors' Fund Act 1951, if otherwise qualified. [Note: The Uniform Civil Procedure Rules 2005 provide (Rule 36.11) that unless the Court otherwise orders, a judgment or order is taken to be entered when it is recorded in the Court's computerised court record system. Setting aside and variation of judgments or orders is dealt with by Rules 36.15, 36.16, 36.17 and 36.18.
