Appeal allowed in part. 2. Set aside order (1) entered on 16 December 2011 and, in place thereof, give judgment for the plaintiff in the sum of $11,424,000. 3. Each party file and serve within 14 days his or her primary submissions with respect to appropriate orders as to the costs of the trial and the costs of the appeal, such submissions not to exceed 10 pages. 4. If there have been offers of compromise relied upon by the parties, the submissions should be accompanied by an affidavit annexing the relevant material. 5. Each party should have a further period of 14 days to reply to the principal submissions of the other party, such replies not to exceed 5 pages. [Note: The Uniform Civil Procedure Rules 2005 provide (Rule 36.11) that unless the Court otherwise orders, a judgment or order is taken to be entered when it is recorded in the Court's computerised court record system. Setting aside and variation of judgments or orders is dealt with by Rules 36.15, 36.16, 36.17 and 36.18.
