(2) Appeal allowed. (3) Set aside orders of the District Court made on 22 March 2013. (4) In place thereof, (a) dismiss the defendant's motion of 27 September 2012 seeking to dismiss the proceedings pursuant to s 73(7) of the Motor Accidents Compensation Act 1999 (NSW); (b) order the defendant to pay the plaintiff's costs of the defendant's motion. (5) Order the respondent to pay the applicant/appellant's costs of the application for leave to appeal and appeal. [Note: The Uniform Civil Procedure Rules 2005 provide (Rule 36.11) that unless the Court otherwise orders, a judgment or order is taken to be entered when it is recorded in the Court's computerised court record system. Setting aside and variation of judgments or orders is dealt with by Rules 36.15, 36.16, 36.17 and 36.18.
