(2) If the defendant wishes to file any further Defence in these proceedings, then he must first seek leave to do so by filing and serving a Notice of Motion and affidavit in support, which includes the proposed Defence. (3) Together with the Notice of Motion and affidavit, the defendant is to file and serve written submissions, no more than 10 pages in length, setting out the basis upon which the Court ought to grant leave to file the Defence. (4) Within 7 days after service of the Notice of Motion upon the plaintiff, the plaintiff is to file and serve any written submissions in opposition to the leave being sought. (5) The Notice of Motion will, unless otherwise ordered by a Judge of the Court, be dealt with on the papers. (6) The costs of the Notice of Motion dated 16 June 2016 filed by the plaintiff are to be paid by the defendant. (7) The proceedings are fixed for further directions before the Registrar of the Common Law Division on Monday 5 September 2016 at 9am.
