5 The Respondent's application for costs in the proceedings below is remitted to the Tribunal below for redetermination, having regard to the outcome of this appeal and the outcome of the matter remitted to the Tribunal under Order 3.
6 Direct that, if either party wishes to apply for costs of the appeal, that party is to provide to the Appeal Unit of the Tribunal and the other party written submissions on the question of costs of the appeal, within 14 days of the date of this decision.
