Medium Neutral Citation: Application by the Attorney-General in and for the State of NSW in the Estate of Raimon Gruss [2016] NSWSC 1267 Hearing dates: 06 September 2016 Date of orders: 06 September 2016 Decision date: 06 September 2016 Jurisdiction: Common Law Before: Wilson J Decision: (1) Pursuant to ss 33(1) and 33(3)(b) of the Evidence on Commission Act 1995 (NSW), I order that Citigroup Pty Ltd produce account statements for each account held by Raimon Gruss with Citigroup Pty Ltd showing the balance of each account as at 12 February 2012 and 31 March 2015.
(2) The plaintiff has leave to issue and serve a subpoena to produce addressed to the Proper Officer, Citigroup Pty Ltd substantially in the form annexed to the affidavit of Ms O'Connor (the affidavit to which I have already referred) at annexure I of the affidavit.
(3) At the time of service of the subpoena issued pursuant to these orders Citigroup Pty Ltd is also to be provided with copies of the summons filed on 25 August 2016, a copy of the affidavit of Rosa O'Connor of 25 August 2016 and a copy of these orders.
(4) Following answer of the subpoena by Citigroup Pty Limited the Registrar of this Court is to issue a certificate in the form annexed to the affidavit of Ms O'Connor of 25 August 2016 as annexure J.
