The decision of the Tribunal to dismiss the application in relation to the alleged breach of s 18 of the Privacy and Personal Information Protection Act 1998 is set aside. 5. That part of the case that relates to an alleged breach of s 18 of the Privacy and Personal Information Protection Act 1998 is dealt with by way of a new hearing. 6. The application in relation to alleged breaches of s 18 of the Privacy and Personal Information Protection Act 1998 is dismissed. 7. Any application in respect of the costs of the proceedings 1230226 below are to be determined by a differently constituted Tribunal at first instance.
