That pursuant to section 82 of the Civil Procedure Act 2005 (NSW), within 28 days of the date of this order, the Defendant to pay to the Plaintiff the sum of $100,000 as an interim payment of the damages sought to be recovered in the proceedings.
2. That this interim payment is to be deducted from the amount of damages assessed by the Court on final judgment or else credited against any prior settlement of the proceedings.
