BUILDING AND CONSTRUCTION – Building and Construction Industry Security of Payment Act 1999 (NSW) – Adjudicator's fees – Where the adjudicator had determined that the plaintiff should pay all of the adjudicator's fees, but the adjudicator's determination is set aside due to jurisdictional error involving part of the determination, and the Court uses its discretion to impose a condition on the successful plaintiff that it will accept liability for half of the adjudicator's fees.
