Part 1 Introduction

1 Name of plan This plan is Penrith Local Environmental Plan 1998 (Urban Land).

2 Area covered by this plan (1) This plan applies to the land within the City of Penrith which is shown edged by a heavy black line on the map. (2) Despite subclause (1), this plan does not apply to land referred to on the map as "DEFERRED MATTER".

3 Relationship to other environmental planning instruments (1) This plan affects the provisions of Penrith Planning Scheme Ordinance, local environmental plans and deemed environmental planning instruments in the manner set out in Schedule 1. (2) Nothing in this plan affects the application of Penrith Local Environmental Plan 1991 (Environmental Heritage Conservation) to land to which this plan applies.

4 Interpretation (1) Terms used in this plan which are defined in Schedule 2 have the meanings set out in that Schedule. (2) In this plan— (a) a reference to a building or place used for a purpose includes a reference to a building or place intended to be used for the purpose, and (b) a reference to a map is to a map kept in the office of the council. (3) Clause 29 of the Environmental Planning and Assessment (Savings and Transitional) Regulation 1998 applies to this plan as if this plan had commenced before 1 July 1998, despite any other provision of this plan. (4) Notes included in this plan do not form part of this plan.

5 Consent authority The council is the consent authority for the purposes of this plan.

6 Suspension of certain covenants etc (1) Any agreement, covenant or similar instrument which would otherwise prohibit or restrict development permitted by this plan does not apply to the extent necessary to permit that development. (2) Nothing in subclause (1) affects the rights or interests of any public authority under any registered instrument. (3) In accordance with section 28 of the Act, the Governor approved of subclauses (1) and (2) before this plan was made.
