Passenger Transport (Opal and Other Fares) Order 2016
1 Name of Order This Order is the Passenger Transport (Opal and Other Fares) Order 2016.
2 Commencement This Order commences on 5 September 2016 and is required to be published in the Gazette.
3 Definitions (1) In this Order— approved payment device has the same meaning as in Part 6 of the Passenger Transport (General) Regulation 2017. light rail service means a public passenger service provided by means of a light rail vehicle. Manly Fast Ferry means a ferry service operated by Manly Fast Ferry Pty Ltd (ACN 135 008 070) under the authority of a passenger service contract with TfNSW. on-demand bus service means a booked bus service. Opal single trip ticket means a ticket issued by TfNSW as an Opal single trip ticket. Opal smartcard means a smartcard issued by TfNSW as an Opal smartcard. private ferry service means a ferry service operated under the authority of a passenger service contract with TfNSW and for a route specified in Part 1 of Schedule 1A. rural and regional bus service means a bus service operated under the authority of a passenger service contract with TfNSW that is described as a "Rural and Regional Bus Service Contract". Sydney Ferries means a ferry service operated by Transdev Sydney Ferries Pty Ltd (ACN 156 137 236) under the authority of a passenger service contract with TfNSW. the Act means the Passenger Transport Act 2014.
Note. The Act and the Interpretation Act 1987 contain definitions and other provisions that affect the interpretation and application of this Order. (2) Notes included in this Order do not form part of this Order.
4 Maximum fares (1) The fares in respect of rail passenger services (other than light rail services) supplied in accordance with an Opal smartcard, Opal single trip ticket or an approved payment device are set out in Part 1 of Schedule 1. (2) The fares in respect of light rail services supplied in accordance with an Opal smartcard, Opal single trip ticket or an approved payment device are set out in Part 2 of Schedule 1. (3) The fares in respect of bus services supplied in accordance with an Opal smartcard or Opal single trip ticket are set out in Part 3 of Schedule 1. (4) The fares in respect of ferry services supplied in accordance with an Opal smartcard, Opal single trip ticket or an approved payment device are set out in Part 4 of Schedule 1. (4AA) The fares in respect of private ferry services and rural and regional bus services are set out in Schedule 1A. (4A) The Opal smartcard fares set out in Parts 1–4 of Schedule 1 are subject to the fare caps set out in Part 5 of that Schedule. The fare caps do not apply to Opal single trip ticket fares. (4B) (Repealed) (5) The fares in respect of bus services referred to in Schedule 2 are set out in that Schedule. (6) The unit-based fares in respect of booked rail passenger services supplied by NSW Trains in accordance with any of the tickets referred to in Part 1 of Schedule 3 are set out in that Part of that Schedule. (7) Certain other fares in respect of booked rail passenger services supplied by NSW Trains are set out in Part 2 of Schedule 3. (8) Any concession fare set out in Schedule 1, 1A or 3 is available only— (a) to persons of or above the age of 4 years but under the age of 16 years, and (b) to the eligible holders of concessional travel passes issued under— (i) section 88 of the Transport Administration Act 1988, or (ii) any scheme approved by the Minister under clause 8 of Schedule 1 to that Act. (9) (Repealed) (10) The fares provided for in this Order are maximum fares.
