Fair Trading (FuelCheck) Order 2016

The Secretary of the Department of Finance, Services and Innovation makes the following Order.

Explanatory note
The object of this Order is to establish a scheme for the publication of standard retail prices of prescribed fuel available for the fuelling of motor vehicles at service stations on an ongoing and up-to-date basis; to specify requirements for the registration of service stations or service station operators for the purposes of the scheme; and, to specify requirements for the notification of the standard retail prices.
This Order is made under section 58 of the Fair Trading Act 1987.

1 Name of Order
This Order is the FuelCheck Order 2016.
2 Commencement
This Order commences on the day on which it is published on the NSW legislation website. 3 Registration of service station operators
(1) Operators of service stations must register with NSW Fair Trading using the form provided for this purpose on the website at www.fairtrading.nsw.gov.au: (i) if they are already in business at the time of this order — by 14 July 2016 (ii) | otherwise — before they first sell fuel to retail customers. (2) Operators must provide the following details: (i) Name of legal entity which operates the service station (ii) | ABN and ACN for the entity (iii) | Trading name for the service station (if any) (iv) Fuel brand used at the service station (if any) (v) Types of fuel offered for sale at the service station (vi) | Address including number, street name and suburb (vii) | Telephone number for the service station (viii) | Trading hours for the service station (ix) Name of the primary contact person for the service station (x) Position or title of the primary contact person (xi) Mobile telephone number for the primary contact person (xii) Email address for the primary contact person.
