Essential Services Proclamation 2022

under the Essential Services Act 1988

I, the Honourable Margaret Beazley AC QC, Governor of New South Wales, with the advice of the Executive Council, under the Essential Services Act 1988, section 8, make the following Proclamation.

Explanatory note The objects of this Proclamation are to—

(a) declare the supply or distribution of natural gas is an essential service in relation to which regulations may be made under the Essential Services Act 1988, section 9, and

(b) specify the Minister for Energy is the Minister with responsibility for recommending the making, and for the administration and enforcement, of the regulations.

Name of Proclamation This Proclamation is the Essential Services Proclamation 2022.

Commencement

This Proclamation commences on the day on which it is published on the NSW legislation website. Definitions

In this Proclamation—

the Act means the Essential Services Act 1988.

Note— The Act and the /nterpretation Act 1987 contain definitions and other provisions that affect the interpretation and application of this Proclamation.

Grounds for Proclamation

It appears to the Governor that the supply or distribution of natural gas is likely— (a) _ to be interrupted or reduced, or (b) otherwise to be rendered insufficient for the reasonable requirements of the community. Declaration of essential service and specification of responsible Minister

(1) | The supply or distribution of natural gas is declared to be an essential service in relation to which regulations may be made under the Act, section 9.
