An Act to amend "Saywell's Tramway Act of 1884." [28th April, 1887. |
\WV BEREAS by an Act passed in the forty-seventh year of Her
present Majesty's reign intituled "An Act to authorize the construction and maintenance of a Tramway from the proposed Bay- street Station on the Illawarra Railway to and along Lady Robinson's Beach' Thomas Saywell his heirs executors administrators and assigns were authorized to make and construct a tramway upon a certain route mentioned and described in the said Act And whereas it is necessary for the safe and convenient working of the said tramway that loop- lines and sidings should be made for use in connection with the said tramway and the said Thomas Saywell has made a loop-line at the end

of the said tramway-line near to the Illawarra Railway Line and is desirous of making other loop-lines and sidings at other parts thereof And whereas doubts have arisen whether the said Thomas Saywell is authorized by the said Act to make such loop-lines or sidings Be it therefore enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled and by the authority of the same as follows :—
1. It shall be lawful for the said Thomas Saywell his heirs Power to construct executors administrators and assigns to make construct maintain and [Pie oF sidings. use in connection with the said tramway-line such loop-lines and sidings not exceeding two in number as may be required for the safe and convenient working and use of the said tramway and from time to time to alter and repair the same.
2. It shall be lawful for the said Thomas Saywell his heirs Legulizing clause. executors administrators and assigns to continue maintain and from time to time to alter and repair the loop-line or siding heretofore made by the said Thomas Saywell at the end of the said tramway-line near to the Illawarra Railway Line in addition to those authorized by the previous clause and it is hereby enacted that the said Thomas Saywell shall be deemed to have authority to make and continue the said loop- line or siding in the same manner as if he had been expressly authorized thereto by the provisions of the said recited Act.
