CANTERBURY MUNICIPALITY (BAZENTIN AND PERSIC STREETS RECREATION RESERVE) ACT.

An Act to authorise the Council of the Municipality of Canterbury to convey and transfer certain lands within the said Municipality in exchange for certain other lands; and for purposes connected therewith. [Assented to, 2nd October, 1968.]
HEREAS by a Memorandum of Transfer dated the preamble. Thirtieth day of December One thousand nine hundred
and twenty-five the War Service Homes Commissioner,
a body corporate under the War Service Homes Act 1918-
1925, transferred to the Council of the Municipality of Canter-
bury certain land at the corner of Bazentin Street and Persic
Street, Belfield, having an area of 16} perches, being the
land marked as "Recreation Reserve" on Deposited Plan
12859 and being the land comprised in Certificate of Title

Canterbury Municipality (Bazentin and Persic Streets Recreation Reserve).
Volume 3989 Folio 19, in consideration of the said Council entering into a certain covenant as to the purposes for which the land could be used: AND WHEREAS the said land became vested in the said Council in fee simple subject only to the said covenant: AND WHEREAS the said Council has since held and used the said land for the purpose of providing a recreation reserve, being one of the purposes permitted under the terms of the said covenant: AND WHEREAS there is vested in certain persons as Trustees for the Belfield Sub-Branch of the Returned Services League of Australia (New South Wales Branch) Incorporated (hereinafter referred to as "the Sub-Branch") certain land being Lot 16 of Section D on Deposited Plan 12859, being the land comprised in Certificate of Title Volume 5632 Folio 221 and Lot 1 on Deposited Plan 519227, being the land comprised in Certificate of Title Volume 10301 Folio 70: AND WHEREAS there is vested in the same persons as Trustees for the Sub-Branch certain other land fronting Persic Street Belfield adjoining the said land in Certificate of Title Volume 3989 Folio 19 being Lot 18 of Section D on Deposited Plan 12859 and being the land comprised in Certificate of Title Volume 3676 Folio 238 : AND WHEREAS the Sub-Branch has constructed certain improvements on the said Lot 18 and wishes to extend its improvements to the said land adjoining being the said land in Certificate of Title Volume 3989 Folio 19 : AND WHEREAS the Sub-Branch is willing to transfer to the said Council part of the said Lot 16 on Deposited Plan 12859 and Lot 1 on Deposited Plan 519227, being so much thereof as shall have an area of 17 perches and be of the dimensions bearings as set out in the Second Schedule hereto: AND WHEREAS the said Council has no authority under the Local Government Act, 1919, as amended by subsequent Acts, to sell or exchange any part of a public reserve: AND WHEREAS it is expedient to authorise the said Council to convey and transfer the said land in Certificate of Title Volume 3989 Folio 19 to the Sub-Branch in exchange for so much of the said Lot 16 on Deposited Plan 12859 and Lot 1 on Deposited Plan 519227 as shall have an area of 17 perches and shall have such dimensions as set out in the Second Schedule hereto :
