Fair Trading Inspectors Act 2014

An Act to provide for the powers of inspectors under legislation about fair trading

Chapter 1 Preliminary

1 Short title This Act may be cited as the Fair Trading Inspectors Act 2014.

2 Commencement This Act commences on a day to be fixed by proclamation.

3 Act binds all persons (1) This Act binds all persons, including the State, and, so far as the legislative power of the Parliament permits, the Commonwealth and the other States. (2) Nothing in this Act makes the State, the Commonwealth or another State liable to be prosecuted for an offence.

4 Operation of Act (1) This Act enacts common provisions for the following Acts (each a primary Act)— (a) Agents Financial Administration Act 2014; (b) Associations Incorporation Act 1981; (c) Body Corporate and Community Management Act 1997, chapter 5, part 2, division 5, subdivisions 2 and 3; (d) Building Units and Group Titles Act 1980, part 4, division 3, subdivision 2; (e) Debt Collectors (Field Agents and Collection Agents) Act 2014; (f) Funeral Benefit Business Act 1982; (g) Introduction Agents Act 2001; (h) Land Sales Act 1984; (i) Manufactured Homes (Residential Parks) Act 2003; (j) Motor Dealers and Chattel Auctioneers Act 2014; (k) Property Occupations Act 2014; (l) Residential Services (Accreditation) Act 2002; (m) Retirement Villages Act 1999; (n) Second-hand Dealers and Pawnbrokers Act 2003; (o) Security Providers Act 1993; (p) South Bank Corporation Act 1989, part 9A, divisions 5 and 6; (q) Tourism Services Act 2003. (2) The common provisions mostly concern— (a) the appointment and powers of inspectors for primary Acts; and (b) the procedures relating to the exercise of the powers.
