Part 1.1 Preliminary

1 Short title This regulation may be cited as the Legal Profession Regulation 2017. Note— The part numbering of this regulation reflects the part numbering of the Legal Profession Act 2007. Accordingly, sections in each part of this regulation relate to the corresponding part in the Act. As not every part of the Act has corresponding sections in this regulation, the part numbering of this regulation is not sequential.

2 Commencement This regulation commences on 1 September 2017.

2A Rounding of amounts expressed as numbers of fee units (1) This section applies for working out the amount of a fee expressed in this regulation as a number of fee units. (2) For the purpose of the Acts Interpretation Act 1954, section 48C(3), the amount is to be rounded— (a) if the result is not more than $100—to the nearest multiple of 5 cents (rounding one-half upwards); or (b) if the result is more than $100 but not more than $1,000—to the nearest multiple of 10 cents (rounding one-half upwards). Example for paragraph (a)— If a fee were 35 fee units and the value of a fee unit were $1.015, the number of dollars obtained by multiplying 35 by $1.015 would be $35.525. Because $35.525 is halfway between $35.50 and $35.55, it is rounded upwards, so the amount of the fee would be $35.55.

Part 1.2 Interpretation

3 Definitions The dictionary in schedule 2 defines particular words used in this regulation.

4 Prescribed home jurisdiction criteria— Act , s 8 For section 8(3)(b)(iii) of the Act, the following criteria are prescribed in relation to an associate of a law practice— (a) the jurisdiction of the associate's place of residence in Australia; (b) if the associate does not have a place of residence in Australia, the jurisdiction of the associate's last place of residence in Australia.
