Motor Accident Insurance Act 1994
An Act to provide for a compulsory third-party insurance scheme covering liability for personal injury arising out of motor vehicle accidents, and for other purposes
Part 1 Preliminary
1 Short title This Act may be cited as the Motor Accident Insurance Act 1994.
2 Commencement This Act commences on a day to be fixed by proclamation.
3 Objects The objects of this Act are— (a) to continue and improve the system of compulsory third-party motor vehicle insurance (CTP insurance), and the scheme of statutory insurance for uninsured and unidentified vehicles, operating in Queensland; and (b) to establish a basis for assessing the affordability of CTP insurance; and (c) to keep the costs of CTP insurance at a level the average motorist can afford; and (d) to promote competition in the setting of premiums for CTP insurance; and (e) to provide for the licensing and supervision of insurers providing CTP insurance under CTP insurance policies; and (f) to encourage licensed insurers to act in a way that supports the integrity of, and public confidence in, the statutory insurance scheme; and (g) to encourage the speedy resolution of personal injury claims resulting from motor vehicle accidents; and (h) to promote and encourage, as far as practicable, the rehabilitation of claimants who sustain personal injury because of motor vehicle accidents; and (i) to establish and keep a register of claims to help the administration of the statutory insurance scheme and the detection of fraud; and (j) to promote measures directed at eliminating or reducing causes of motor vehicle accidents and mitigating their results; and (k) to establish measures directed at eliminating or reducing the practice of giving or receiving consideration for a claim referral or potential claim referral, or soliciting or inducing a claimant to make a claim, in contravention of this Act.
