Jurisdiction of Courts (Cross-vesting) Amendment

The Parliament of Queensland enacts—

Short title

Clause1. This Act may be cited as the Jurisdiction of Courts (Cross-vesting) Amendment Act 1993.

Commencement

Clause2. This Act commences on a day to be fixed by proclamation.

Amended Act

Clause3. The Jurisdiction of Courts (Cross-vesting) Act 1987 is amended as set out in this Act.

Amendment of s.3 (Interpretation)

Clause4.(1) Section 3(1) (definitions "State" and "Territory")— omit. (2) Section 3(1)— insert—

' "State" includes the Northern Territory and the Australian Capital Territory;

"Territory" does not include the Northern Territory or the Australian Capital Territory.'.

(3) Section 3(3)—

omit.

Replacement of s.6 (Special federal matters)

Clause5. Section 6— 11316 18 20 22

Jurisdiction of Courts (Cross-vesting) Amendment

omit, insert— 'Special federal matters "6.(1) If—

(a) a matter for determination in a proceeding that is pending in the Supreme Court is a special federal matter; and

(b) the court does not make an order under subsection (3) in respect of the matter;
