An Act to amend the Lang Park Trust Act 1962, and for related purposes Lang Park Trust Amendment
The Parliament of Queensland enacts—
Short title
Clause1. This Act may be cited as the Lang Park Trust Amendment Act 1993.
Amended Act Clause2. The Lang Park Trust Act 1962 is amended as set out in this Act.
Insertion of new s.9A
Clause3. After section 9— insert—
'Redevelopment of site *9A.(1) In this section—
"application" means the application made by the Trust on or about 19 July 1993 under section 4.12 of the Local Government (Planning and Environment) Act 1990 seeking the consent of the Brisbane City Council to the redevelopment of the site;
"planning scheme" means the planning scheme for the City of Brisbane in force for the time being under the Local Government (Planning and Environment) Act 1990.
"site" means the land described as Lot 354 on R.P. 227068 in the County of Stanley, Parish of North Brisbane, City of Brisbane;
'(2) Despite any other Act, the planning scheme— (a) does not apply to the site; and (b) is taken not to have applied to the site from 1 July 1993. '(3) The application is of no effect and is taken to have never been made.
'(4) The Trust is taken to be a statutory body declared under section 4(5)(a)(iii) of the Building Act 1975. 11 1315 1720 2224 26 Lang Park Trust Amendment
'(5) To remove any doubt, the carrying out of the work of redeveloping the site is not unlawful by reason only of the absence of an approval by the
Brisbane City Council.
'(6) The Governor in Council may make regulations for the purposes of redeveloping the site.
