Child Protection (Recognition of Relative Carers)
Amendment Bill 2005
The Parliament of Queensland enacts—
1 Short title
This Act may be cited as the Child Protection (Recognition of
Relative Carers) Amendment Act 2005.
2 Commencement
This Act commences on a day to be fixed by proclamation.
3 Act amended
This Act amends the Child Protection Act 1999.
4 Insertion of new ch 4A
After chapter 4—
insert—
'Chapter 4A Recognition of relative
carers
'148A Recognition of grandparent, uncle, aunt or sibling as
carer

A grandparent, uncle, aunt or sibling of a child may apply to
the chief executive for recognition of his or her status as the
child's carer.
The chief executive may grant recognition if satisfied that the
applicant—
(a) is a grandparent, uncle, aunt or sibling of the child; and
(b) is a primary carer of the child.
This section is not intended by itself to prevent a child's
grandparent, uncle, aunt or sibling from acting as the child's
carer without approval or recognition under this Act.

5 Amendment of s 159 (Payments for care and
maintenance)
(1) Section 159(1), after 'carer' —
insert—
'or recognised relative carer'.
(2) Section 159(2), 'chief executive to the person or the person's
carer' —
omit, insert—
'chief executive, or in the care of a recognised relative carer,
to the person or the person's carer or recognised relative
carer'.
(3) Section 159—
insert—
'(4) In this section—
recognised relative carer means a person recognised as a
carer under section 148A.'.
