Soft Drinks (Prohibition From Selling at Schools) Bill The Parliament of Queensland enacts—

1 Short title

This Act may be cited as the Soft Drinks (Prohibition From Selling at Schools) Act 2005.

2 Commencement

This Act commences on a day to be fixed by proclamation.

3 Selling soft drinks at school premises prohibited

A person must not sell a soft drink at school premises. Maximum penalty—

(a) for an individual—1 penalty unit; or

(b) for a corporation—10 penalty units.

Subsection (1) does not apply to a person who—

(a) _ hires the whole or part of school premises for an activity outside of the school hours of the school; and

(b) _ sells a soft drink at the premises in the course of the activity.

In this section— at, in relation to premises, includes in or on the premises.

non-State school means a school that is provisionally accredited, or accredited, under the Education (Accreditation of Non-State Schools) Act 2001.

premises includes a building together with surrounding land.

school hours, of a school, means the hours in which the school is open as a school.

school premises means the premises of a State educational institution or non-State school.

Soft Drinks (Prohibition From Selling at Schools) Bill soft drink means an aerated drink containing—

(a) at least 5 grams of sugar for each 100 mL of the drink; or

(b) artificial sweetener.

State educational institution see the Education (General Provisions) Act 1989, section 2(1).
