The Parliament of Queensland enacts—
1 Short title
This Act may be cited as the Civil Liability (Good Samaritan) Amendment Act 2007.
2 Act amended
This Act amends the Civil Liability Act 2003.
3 Amendment of ch 2, pt 1, div 7 hdg
Chapter 2, part 1, division 7 heading, after 'safety'—
insert—
'and assisting persons in distress' .
4 Insertion of new s 27A
Chapter 2, part 1, division 7—
insert—
'27A Protection of persons assisting persons in distress
'(D)
(2)
Civil liability does not attach to a person in relation to an act done or omitted in the course of rendering first aid or other aid or assistance to a person in distress if—
(a) the first aid or other aid or assistance is given in circumstances of emergency; and
(b) the act is done or omitted in good faith and without reckless disregard for the safety of the person in distress or someone else.
Subsection (1) does not limit or affect section 26 or the Law Reform Act 1995, part 5.'.
