The Parliament of Queensland enacts—

Part 1 Preliminary

1 Short title

This Act may be cited as the Criminal Code and Other Acts (Graffiti Clean-up) Amendment Act 2008.

Part 2 Amendment of Criminal Code

2 Code amended in pt 2 This part amends the Criminal Code.

3 Amendment of s 469 (Wilful damage)

(1) Section 469, punishment in special cases, clause 9(3), 'may'—

omit, insert— 'must'.

(2) Section 469, punishment in special cases, clause 9— insert—

'(4) Subclause (3), as amended by the Criminal Code and Other Acts (Graffiti Clean-up) Amendment Act 2008, section 3(1), applies in relation to an offence whether the offence was committed before or after the commencement of this subsection.'.
