The Parliament of Queensland enacts—

Short title

This Act may be cited as the Criminal Code (Filming or

Possessing Images of Violence Against Children) Amendment Act 2009.

Act amended This Act amends the Criminal Code.

Amendment of s 207A (Definitions for this chapter)

(1) Section 207A, definition child exploitation material, 'under 16 years'-—

omit.

(2) Section 207A, definition child exploitation material, paragraph (c)—

insert—

'Example of abuse—

verbal or physical bullying'.

Insertion of new s 228DA After section 228D—

insert—

'228DA Confiscating devices used to commit offences in

relation to bullying

'(1) This section applies if a police officer or school principal

reasonably believes a mobile phone, computer or other thing has just been used, or is being used, to commit an offence against section 228A, 228B, 228C or 228D that involves child exploitation material describing or depicting someone who is, or apparently is, a child being subjected to abuse by bullying.
