Short title
This Act may be cited as the Criminal Code (Looting in Declared Areas) Amendment Act 2014.
Code amended
This Act amends the Criminal Code.
Amendment of s 398 (Punishment of stealing) (1) Section 398, punishment in special cases, clause 13—
insert—
(c) the offence is committed in an area that at
a
the time of the commission of the offence is declared area under the Disaster
Management Act 2003; or
(d) the following applies—
(i)
(ii)
the thing stolen is left unattended because the person in possession of the property was required to leave it unattended to comply with a direction given by a person exercising a power under the Disaster Management Act 2003;
it is not clear whether the thing stolen was stolen—
(A) during the period when the place from which it was stolen was in a declared area; or
(B) after that period but before the person returned to the thing;
(2) Section 398, punishment in special cases, clause 13—

A certificate by the chief executive of the department in which the Disaster Management Act 2003 is administered stating any of the following matters is evidence of the matter—
(a) a stated area was a declared area under the Disaster Management Act 2003 during a stated period;
