Part 1 Preliminary
1 Short title This Act may be cited as the Public Health and Other Legislation (Public Health Emergency) Amendment Act 2020.
2 Commencement Part 11, division 3 commences 1 year after the date of assent of this Act.

3 Act amended This part amends the City of Brisbane Act 2010.

Part 5A Provisions for 2020 quadrennial election
240A Minister may give directions about filling vacancies in office of councillors (1) This section applies— (a) if the 2020 quadrennial election is not held in March 2020 under the Local Government Electoral Act 2001, part 9A; and (b) until the day before the 2020 quadrennial election is held. (2) Section 163(2), (3) and (6) does not apply to the council. (3) The Minister may give a direction to the council about whether or not a vacant office of a councillor (including the mayor) must be filled. (4) If the vacant office must be filled, the Minister may, by notice to the council, extend the period within which the council must fill the vacancy under section 163(4). (5) If the Minister extends the period under subsection (4), the Governor in Council may appoint a qualified person under section 163(5) to fill the vacant office only if the council has not filled the vacancy within the extended period.
