Liquid Fuel Supply (Minimum Biobased Petrol Content) Amendment Bill 2022* (Qld)

An Act to amend the Liquid Fuel Supply Act 1984 for particular purposes The Parliament of Queensland enacts—

1 Short title This Act may be cited as the Liquid Fuel Supply (Minimum Biobased Petrol Content) Amendment Act 2022.

2 Act amended This Act amends the Liquid Fuel Supply Act 1984.

3 Amendment of s 35B (Sustainable biobased petrol requirement) Section 35B(2), penalty— omit, insert— Maximum penalty— (a) for a first offence—400 penalty units; or (b) for a second or later offence—4,000 penalty units.

4 Insertion of new pt 5A , div 1 , sdiv 2A Part 5A, division 1— insert—

Subdivision 2A Other requirements for sale of petrol-biobased petrol blends

35DA Minimum biobased petrol content in petrol-biobased petrol blends (1) A fuel seller must not sell a petrol-biobased petrol blend that contains less than 9% biobased petrol in the blend. Maximum penalty— (a) for a first offence—400 penalty units; or (b) for a second or later offence—4,000 penalty units. (2) In a proceeding for an offence against subsection (1), it is a defence for the person charged with the offence to prove that the person did not know, and could not reasonably have known, that the petrol-biobased petrol blend contained less than 9% biobased petrol.

5 Insertion of new s 35T After section 35S— insert—

35T Supporting information for supply of petrol- biobased petrol blends to retailers (1) This section applies if a fuel wholesaler supplies a petrol-biobased petrol blend to a fuel retailer. (2) The fuel wholesaler must give the fuel retailer a document at the time of supply that states the minimum percentage of biobased petrol in the petrol-biobased petrol blend. Maximum penalty—100 penalty units.
