An Act to amend the Criminal Code, the Information Privacy Act 2009, the Ombudsman Act 2001, the Right to Information Act 2009 and the legislation mentioned in schedule 1 for particular purposes The Parliament of Queensland enacts—
Part 1 Preliminary
1 Short title This Act may be cited as the Information Privacy and Other Legislation Amendment Act 2023.
2 Commencement (1) This Act, other than part 6 and schedule 1, part 1, commences on a day to be fixed by proclamation. (2) The Acts Interpretation Act 1954, section 15DA does not apply to this Act.
Part 2 Amendment of Criminal Code
3 Code amended This part amends the Criminal Code. Note— See also the amendment in schedule 1, part 2.
4 Amendment of s 408E (Computer hacking and misuse) (1) Section 408E, heading— omit, insert—

Chapter 108 Transitional provision for Information Privacy and Other Legislation Amendment Act 2023
760 Application of s 408E (1) This section applies if an act or omission constituting an offence against section 408E happened before the commencement, whether the proceeding for the offence is started before or after the commencement. (2) Section 408E as in force before the commencement continues to apply in relation to the act or omission as if the Information Privacy and Other Legislation Amendment Act 2023, section 4 had not commenced.
