Education (General Provisions) and Other Legislation Amendment Bill 2024 (Qld)

An Act to amend the Education and Care Services Act 2013, the Education and Care Services National Law (Queensland) Act 2011, the Education (General Provisions) Act 2006, the Education (General Provisions) Regulation 2017, the Public Health Act 2005, the Working with Children (Risk Management and Screening) Act 2000 and the legislation mentioned in schedule 1 for particular purposes The Parliament of Queensland enacts—

Part 1 Preliminary

1 Short title This Act may be cited as the Education (General Provisions) and Other Legislation Amendment Act 2024.

2 Commencement The following provisions commence on a day to be fixed by proclamation— (a) parts 2 and 3; (b) part 4, division 3; (c) parts 5 to 7; (d) schedule 1, part 2.

Part 2 Amendment of Education and Care Services Act 2013

3 Act amended This part amends the Education and Care Services Act 2013.

4 Amendment of s 8 (Meaning of Queensland education and care service ) (1) Section 8(1)— insert— (ba) a service that is a State school kindergarten program provided at a prescribed State school under the Education (General Provisions) Act 2006, section 419A; (2) Section 8(1)(c), example, 'paragraph (c)'— omit, insert— paragraph (d) (3) Section 8(1)(d), example, 'paragraph (d)'— omit, insert— paragraph (e) (4) Section 8(1)(ba) to (h)— renumber as section 8(1)(c) to (i).

5 Amendment of s 107 (Person must not provide an education and care service without service approval) (1) Section 107, heading— omit, insert—

107 Person must not provide regulated education and care to 7 or more children of particular age without approval (2) Section 107(1), after 'children'— insert— , who are under 13 years of age, (3) Section 107— insert— (3) Subsection (1) does not apply to a person providing regulated education and care as part of a service mentioned in section 8(1)(a) to (i).
