The Parliament of South Australia enacts as follows: Part 1—Preliminary 1—Short title This Act may be cited as the Work Health and Safety (Crystalline Silica Dust) Amendment Act 2022.
Part 2—Amendment of Work Health and Safety Act 2012 2—Insertion of Part 2A After section 34 insert: Part 2A—Ban on work exposing person to crystalline silica dust 34A—Interpretation In this Part— crystalline silica means crystalline polymorphs of silica, including the following substances: (a) cristobalite; (b) quartz; (c) tridymite; (d) tripoli. 34B—Ban on work exposing person to crystalline silica dust A person conducting a business or undertaking must not carry out, or direct or allow a worker to carry out, work that exposes a person to crystalline silica dust. Maximum penalty: (a) in the case of an individual—$300 000; (b) in the case of a body corporate—$1 500 000.
