The Parliament of South Australia enacts as follows: Part 1—Preliminary 1—Short title This Act may be cited as the Statutes Amendment (Assaults on Police Officers) Act 2025.
Part 2—Amendment of Bail Act 1985 2—Amendment of section 10A—Presumption against bail Section 10A(2), definition of prescribed applicant—after paragraph (d) insert: (da) an applicant taken into custody in relation to an offence against section 20AA of the Criminal Law Consolidation Act 1935 allegedly committed against a prescribed emergency worker who is a police officer; or
Part 3—Amendment of Criminal Law Consolidation Act 1935 3—Amendment of section 20AA—Causing harm to, or assaulting, certain emergency workers etc (1) Section 20AA(1), penalty provision—delete the penalty provision and substitute: Penalty: (a) if the prescribed emergency worker is a police officer—imprisonment for not less than 6 months and not more than 15 years; Note— See also Part 3 Division 2A of the Sentencing Act 2017. (b) in any other case—imprisonment for not more than 15 years. (2) Section 20AA(2), penalty provision—delete the penalty provision and substitute: Penalty: (a) if the prescribed emergency worker is a police officer—imprisonment for not less than 6 months and not more than 10 years; Note— See also Part 3 Division 2A of the Sentencing Act 2017. (b) in any other case—imprisonment for not more than 10 years.
