1—Short title These regulations may be cited as the Prisoners (Interstate Transfer) Regulations 2010. 2—Commencement These regulations will come into operation on 1 September 2010. 3—Interpretation In these regulations— Act means the Prisoners (Interstate Transfer) Act 1982; chief executive means the person holding or acting in the position of chief executive of the Department; Department means the administrative unit of the Public Service that is, under the Minister, responsible for the administration of the Act. 4—Section 13 certificate For the purposes of section 13(2) of the Act, the Crown Solicitor is a prescribed officer. 5—Certification of copy documents For the purposes of section 26(2) of the Act, a copy of an order or document referred to in section 26(1) of the Act is certified in the prescribed manner if— (a) the copy is endorsed with a statement that indicates— (i) the name of the person certifying the copy; and (ii) the position in the Department held by the person certifying the copy; and (iii) that the copy is certified to be a true and accurate copy of the original order or document; and (b) the endorsement is signed by or on behalf of the chief executive. 6—Application for revocation of order of transfer For the purposes of section 34 of the Act, the following offices are prescribed: (a) the Minister; (b) the Attorney‑General; (c) the Director of Public Prosecutions; (d) the chief executive.
