The Parliament of South Australia enacts as follows: Part 1—Preliminary 1—Short title This Act may be cited as the Local Government (Rateable Land) Amendment Act 2023. 2—Commencement This Act comes into operation on the first day of the financial year immediately following the financial year in which it is assented to by the Governor.
Part 2—Amendment of Local Government Act 1999 3—Amendment of section 147—Rateability of land (1) Section 147—after subsection (2) insert: (2a) Despite this or any other Act or law, the following land is not exempt from rates (and such land will not be taken to be used or held for a public purpose): (a) land on which casino premises (within the meaning of the Casino Act 1997) are situated; (b) land within the prescribed area on which a building owned or occupied (whether wholly or partly) by a body corporate is situated. (2) Section 147—after subsection (7) insert: (8) In this section— prescribed area means the area within the City of Adelaide bounded— (a) on the north by the southern boundary of Festival Drive; and (b) on the south by the northern boundary of Parliament House extended in a straight line by the shortest route in an easterly direction to the western boundary of King William Road and in a westerly direction to the eastern boundary of the built structure comprising the Adelaide Railway Station; and (c) on the east by the western boundary of King William Road; and (d) on the west by the eastern boundary of the built structure comprising the Adelaide Railway Station extended in a straight line by the shortest route in a northerly direction to the southern boundary of Festival Drive. (9) For the purposes of the definition of prescribed area, a reference to Parliament House will be taken to include a reference to— (a) the premises known as Old Parliament House; and (b) any land appurtenant to Parliament House or Old Parliament House.
