The Parliament of South Australia enacts as follows: Part 1—Preliminary 1—Short title This Act may be cited as the Native Vegetation (Revegetation Projects Register) Amendment Bill 2022.

Part 2—Amendment of Native Vegetation Act 1991 2—Amendment of section 3—Interpretation Section 3(1)—after the definition of the repealed Act insert: revegetation project means— (a) a project under which native vegetation has been established and in respect of which the Council has made a declaration under section 23E (either before or after the commencement of the Native Vegetation (Revegetation Projects Register) Amendment Act 2022); or (b) a project under which native vegetation is established pursuant to a proposal approved by the Council under section 23F (either before or after the commencement of the Native Vegetation (Revegetation Projects Register) Amendment Act 2022); or (c) a project or a class of projects determined by the Council to be included within the ambit of this definition; Revegetation Projects Register means the Revegetation Projects Register established under Part 3 Division 4; 3—Amendment of section 6—Objects Section 6—after paragraph (e) insert: and (f) the recording, management and prioritisation of revegetation projects throughout the State by means of the Revegetation Projects Register. 4—Amendment of section 14—Functions of Council Section 14(1)—after paragraph (a) insert: (ab) to establish and maintain the Revegetation Projects Register, and using the information contained in the register— (i) to appropriately prioritise revegetation projects throughout the State; and (ii) to enhance collaboration between persons and bodies involved or interested in revegetation projects throughout the State, including statutory bodies, departments, councils, developers, non‑government organisations, local communities and landowners; and (iii) to advise the Minister on matters relating to revegetation practice, including, for example, how improvements in design and placement can be made in respect of revegetation; and (iv) to assist in designing landscape‑scale adaptive management approaches that take into consideration the need to adapt to a changing climate and to link up remnant vegetation across the landscape; and 5—Insertion of section 14A After section 14 insert: 14A—Revegetation Projects Committee (1) The Council must establish a committee (the Revegetation Projects Committee) to perform the function of the Council set out in section 14(1)(ab). (2) The Revegetation Projects Committee may perform any other function of the Council as the Council thinks fit. (3) The Council must appoint a member of the Council as the presiding member of the Revegetation Projects Committee. 6—Amendment of heading to section 16 Heading to section 16—after "Staff" insert: and resources 7—Amendment of section 16—Staff and resources Section 16(1)—delete "to assist the Council as the Minister thinks fit" and substitute: and resources that the Council reasonably needs for carrying out the Council's functions 8—Insertion of Part 3 Division 4 After section 22 insert: Division 4—Revegetation Projects Register 22A—Revegetation Projects Register The Council must establish and maintain a register (the Revegetation Projects Register) in accordance with this Division. 22B—Content of Register (1) The Revegetation Projects Register will, with respect to each completed, ongoing or planned revegetation project throughout the State, contain the following information (so far as such information is known to the Council): (a) the proponent of the project; (b) the area that is, or will be, revegetated as a result of the project; (c) a list of the species planted in the area described in paragraph (b); (d) the number of individual plants of each species listed under paragraph (c); (e) the manner and extent of any monitoring of the project that is, or will be, arranged; (f) the cost of the project; (g) any other information prescribed by the regulations. (2) The Council may include other information in the Revegetation Projects Register, or hold other information in association with the Revegetation Projects Register, as the Council thinks fit. 22C—Register to be available for public inspection (1) The Revegetation Projects Register must be available for public inspection on a website determined by the Council. (2) The Council must, on application by a person in writing and on payment of the prescribed fee, provide the person with an extract of the Revegetation Projects Register.
