The Parliament of South Australia enacts as follows: Part 1—Preliminary 1—Short title This Act may be cited as the Planning, Development and Infrastructure (Gas Infrastructure) Amendment Act 2022.
Part 2—Amendment of Planning, Development and Infrastructure Act 2016 2—Insertion of section 243A After section 243 insert: 243A—Requirements to connect to gas infrastructure void (1) Despite any other Act or law, a provision of a contract or arrangement that provides that an owner or occupier of land used (or to be used) for residential purposes is required to connect to or use infrastructure, equipment or any other facility in connection with the distribution or supply of gas is void and of no effect. (2) This section applies to a provision of a contract or arrangement entered into on or after 1 January 2023. (3) This section does not apply to a contract or arrangement entered into by an entity authorised under an Act or law to engage in the generation, distribution, sale or supply of gas.
