The Parliament of South Australia enacts as follows: Part 1—Preliminary 1—Short title This Act may be cited as the Food (Restrictions on Advertising of Junk Food) Amendment Act 2022. 2—Commencement This Act comes into operation 3 months after assent.
Part 2—Amendment of Food Act 2001 3—Insertion of section 20A After section 20 insert: 20A—Advertising of junk food in certain locations (1) A person must not advertise junk food— (a) within 500 metres of any school; or (b) at any bus or tram stop or railway station; or (c) on any property in the ownership or occupation of the Crown in right of this State. Maximum penalty: (a) If the offender is a body corporate—$50 000. (b) If the offender is a natural person—$5 000. (2) In this section— junk food means any highly processed or refined food or beverage that is low in nutrients and is high in kilojoules, saturated fat, sugars or added salt.
