The Parliament of South Australia enacts as follows: Part 1—Preliminary 1—Short title This Act may be cited as the Tobacco and E‑Cigarette Products (Miscellaneous) Amendment Act 2024. 2—Commencement This Act comes into operation on 1 January 2025.

Part 2—Amendment of Tobacco and E‑Cigarette Products Act 1997 3—Amendment of section 3—Objects of Act Section 3(b)(ii)—delete "children" and substitute: designated persons 4—Amendment of section 4—Interpretation Section 4(1)—after the definition of contravene insert: designated person means a person born on or after 1 January 2009; 5—Amendment of section 37—Sale of tobacco products or e‑cigarette products by vending machine (1) Section 37(1)—delete "unless—" (2) Section 37(1)(a) and (b)—delete paragraphs (a) and (b) 6—Amendment of section 38A—Sale or supply of tobacco products or e‑cigarette products to children (1) Section 38A, heading—delete "children" and substitute: designated persons (2) Section 38A(1)—delete "child" and substitute: designated person (3) Section 38A(2)(a)—delete "minor" and substitute: designated person (4) Section 38A(2)(b)—delete "minor" and substitute: designated person (5) Section 38A(2)(c)—delete "minor" first occurring and substitute: designated person (6) Section 38A(2)(c)—delete "minor was of or above the age of 18 years" and substitute: designated person was born before 1 January 2009 (7) Section 38A(3)—delete "child was of or above the age of 18 years" and substitute: designated person was born before 1 January 2009 (8) Section 38A(5)—delete "or who occupies premises in which a vending machine that is designed to sell tobacco such products is situated" (9) Section 38A(5)—delete "or of persons using the machine" (10) Section 38A(6), definition of responsible person—delete "child" first occurring and substitute: designated person (11) Section 38A(6), definition of responsible person, (a)—delete "otherwise than by means of a vending machine" (12) Section 38A(6), definition of responsible person, (b)—delete paragraph (b) 7—Amendment of section 39—Power to require evidence of age Section 39(1)—delete "child" and substitute: designated person
