The Parliament of South Australia enacts as follows: Part 1—Preliminary 1—Short title This Act may be cited as the Health Care (Acquisition of Property) Amendment Act 2022.
Part 2—Amendment of Health Care Act 2008 2—Repeal of section 40 Section 40—delete the section 3—Insertion of section 90A After section 90 insert: 90A—Acquisition of property (1) The Minister may, subject to and in accordance with the Land Acquisition Act 1969, acquire land if the Minister considers that the acquisition of the land is reasonably necessary for the purposes of the provision of health services. (2) This section does not limit or affect the power of the Minister, a HAC, an incorporated hospital or SAAS to acquire land, or an interest in land, by agreement.
Schedule 1—Transitional provision 1—Transitional provision A process to acquire land for the purposes of an incorporated hospital commenced under section 40 of the Health Care Act 2008 before the repeal of that section by section 2 of this Act may be continued and completed in accordance with section 40 as if it had not been repealed.
