Legislative history
1—Short title
These regulations may be cited as the SACE Board of South Australia Regulations 2023.
2—Commencement
These regulations come into operation on the day on which they are made.
3—Interpretation
In these regulations—
Act means the SACE Board of South Australia Act 1983;
Amendment Act means the Senior Secondary Assessment Board of South Australia (Review) Amendment Act 2008;
prescribed certification requirements means any qualification requirements for the achievement of the SACE—
(a) prescribed by the Senior Secondary Assessment Board of South Australia Regulations 2000 (repealed); or
(b) determined by the Board.
4—Transitional arrangements
(1) The Board may continue to award the qualification in existence on the commencement of the Amendment Act on such basis as the Board may determine from time to time.
(2) The prescribed certification requirements will continue to apply (as may be relevant) for students undertaking senior secondary education (within the meaning of the Senior Secondary Assessment Board of South Australia Act 1983 immediately before the commencement of the Amendment Act) until otherwise determined by the Board.
(3) All approvals given or other steps taken by the Board before the commencement of the Amendment Act (and still having force or effect immediately before that commencement) will continue to have effect in all respects on and after that commencement unless or until the Board determines otherwise.
(4) All achievements recognised by the Board before the commencement of the Amendment Act (and being so recognised at the time of that commencement) will continue to have effect in all respects on or after that commencement (unless the Board has valid grounds to revoke the recognition of an achievement in a particular case after that commencement).
5—Fees
The Board may, in appropriate cases, waive or reduce fees that would otherwise be payable to the Board under the Act.
Schedule 1—Repeal of SACE Board of South Australia Regulations 2008
The SACE Board of South Australia Regulations 2008 are repealed.
