Court Security Regulations 2018

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Court Security Act 2017 .

1. Short title These regulations may be cited as the Court Security Regulations 2018 .

2. Commencement These regulations take effect on the day on which the Court Security Act 2017 commences.

3. Interpretation In these regulations – Act means the Court Security Act 2017 .

4. Meaning of tribunal For the purposes of the definition of tribunal in the Act, the following tribunals and bodies are prescribed to be a tribunal for the purposes of the Act: (a) . . . . . . . . (f) the Legal Profession Board of Tasmania established under section 589 of the Legal Profession Act 2007 ; (g) . . . . . . . . (h) . . . . . . . . (i) the Property Agents Board continued under section 5 of the Property Agents and Land Transactions Act 2016 ; (j) the Property Agents Tribunal established in accordance with section 104 of the Property Agents and Land Transactions Act 2016 ; (k) the Tasmanian Civil and Administrative Tribunal established by section 8 of the Tasmanian Civil and Administrative Tribunal Act 2020 . 5. Possession of prohibited objects For the purposes of section 10(2)(e) of the Act, a person may have possession of a prohibited object on court premises, or bring a prohibited object on to court premises, in the circumstances where – (a) the prohibited object is a controlled substance; and (b) the person in possession of the controlled substance is authorised, under any Act, to be in possession of the controlled substance.
