State Policies and Projects Act 1993
An Act to provide for Tasmanian Sustainable Development Policies, to provide for the integrated assessment of projects of State significance, to provide for State of the Environment Reporting and for related purposes [Royal Assent 9 November 1993]
Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:
PART 1 - Preliminary
1. Short title This Act may be cited as the State Policies and Projects Act 1993 .
2. Commencement This Act commences on a day to be proclaimed.
3. Interpretation (1) In this Act, unless the contrary intention appears – agency means – (a) a department or other agency of government of the State or of the Commonwealth; or (b) an authority of the State or of the Commonwealth established for a public purpose; or (c) a planning authority; or (d) the Municipal Association of Tasmania; or (e) any other person undertaking a function for the public benefit; Commission means the Tasmanian Planning Commission established under the Tasmanian Planning Commission Act 1997 ; State of the Environment Report means a report prepared under section 29 ; State Policy means a Tasmanian Sustainable Development Policy. (2) Words and expressions used both in this Act and in the Land Use Planning and Approvals Act 1993 have in this Act, unless the contrary intention appears, the same respective meanings as they have in that Act.
4. Act to bind Crown This Act binds the Crown in right of Tasmania and, so far as the legislative power of Parliament permits, in all its other capacities.
