Disability Services Act 2011
An Act relating to the funding of the provision of specialist disability services, and other goods or services, in relation to persons with disability, the regulation of the use of restrictive interventions in relation to such persons, the repeal of the Disability Services Act 1992 , the consequential amendment of certain legislation, and for related purposes [Royal Assent 21 September 2011]
Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:
PART 1 - Preliminary
1. Short title This Act may be cited as the Disability Services Act 2011 .
2. Commencement (1) The provisions of this Act commence on a day to be proclaimed. (2) However, if the provisions of this Act have not commenced before 1 January 2012, the provisions of this Act commence on that day.
3. Objects The objects of this Act are – (a) to provide for the funding of – (i) the provision of specialist disability services and certain other goods or services; and (ii) research or development activities; and (b) to provide for the effective planning, prioritisation and scrutiny of the provision of specialist disability services and grants under this Act; and (c) to set out principles that are to be applied in relation to the performance or exercise of functions or powers under this Act and in relation to certain activities to which this Act relates; and (d) to enable the setting of standards that are to be met by funded disability services providers in providing, or ensuring the provision of, specialist disability services; and (e) to ensure that funded disability services providers provide, or ensure the provision of, specialist disability services in a manner that meets those standards; and (f) to regulate the use of restrictive interventions by disability services providers and funded private persons.
