1. Citation This notice is the Planning and Development (Part 17 Fees) Notice 2020.
2. Commencement This notice comes into operation as follows — (a) clauses 1 and 2 — on the day on which this notice is published in the Gazette; (b) the rest of the notice — on the day after that day.
3. Terms used (1) In this notice — design includes a draft of the design; design review, in relation to a development that is the subject of a development application to be determined by the Commission under section 274 of the Act, means a review of the design of the development that — (a) was conducted, at the request of the applicant, by the State Design Review Panel before, as the case requires — (i) the application was made or referred to the Commission; or (ii) the Commission was directed to determine the application; or (b) is conducted by the State Design Review Panel for the purposes of the Commission's consideration of the application; State Design Review Panel means the committee called the State Design Review Panel established under Schedule 2 clause 1 of the Act. (2) Other terms used in this notice that are also used in Part 17 of the Act have the same meanings in this notice as they have in that Part.
4. Fees (1) The applicable fee set out in Schedule 1 is payable to the Commission in respect of the following — (a) a development application to be determined by the Commission under section 274 of the Act; (b) an application made under section 279(2) of the Act. (2) The additional fees set out in subclause (3) are payable to the Commission in respect of a development application to be determined by the Commission under section 274 of the Act if 1 or more design reviews were, or are, conducted in relation to the development. (3) The additional fees are — (a) $10 000; and (b) if the number of design reviews is more than 3 — $5 000 per design review after the 3rd design review. (4) A fee payable under this clause is payable by the applicant. (5) Neither subclause (1)(a) nor subclause (2) applies to a development application in respect of which a direction was given under section 272(5) of the Act unless the Minister's consideration of the application for the purposes of section 272(4)(b) of the Act was done at the applicant's request.
