Signed Signed _____________________________ _____________________________ The Honourable Mike Baird MP The Honourable Colin Barnett MLA Premier of New South Wales Premier of Western Australia Dated this 28th day of September 2015 Dated this 4th day of August 2015 1 Name of Declaration This declaration is the Mutual Recognition (Equivalence of Motor Vehicle Repairer Occupations) Declaration 2015. 2 Commencement This declaration commences on the day after it is registered on the Federal Register of Legislative Instruments. 3 Authority This declaration is made under section 32 of the Mutual Recognition Act 1992. 4 Rescission of ministerial declaration in relation to motor vehicle repairer occupations (F2007L02692) The ministerial declaration made on 14 August 2007 in relation to motor vehicle repairer occupations (F2007L02692) is rescinded. 5 Declaration of occupations that are equivalent (1) Column A of the table in the Schedule to this declaration sets out a State (the first State) and a kind of registration for an occupation in that State. (2) Columns B to I inclusive set out each other State (the second State) and a kind of registration for an occupation in that State. (3) The occupation that can only be carried on in the first State by a person with the registration mentioned in Column A for that State is equivalent to the occupation that can only be carried on in the second State by a person with the registration mentioned in the relevant column for the second State. Schedule A Notes to schedule A: 1. This table depicts the registration outcome for any person already licensed in an occupation in a particular jurisdiction (column A of each row) should they seek to be licensed in an occupation in a second jurisdiction (potentially in any other column in the same row). Registration shall be granted by the second jurisdiction in the terms specified provided the applicant possesses a valid registration in the equivalent occupation in the first jurisdiction. 2. If an applicant for mutual recognition holds a licence shown in Column A of the Schedule, but has additional condition/s applying to that licence not shown in the Schedule, then the relevant registration authority in the second jurisdiction shall recognise the primary licence in Column A and may, in issuing a licence, apply those additional conditions to directly replicate the conditions applying to the first jurisdiction licence. 3. If a licence is not included in the declaration, the decision on licence recognition will be made by the relevant registration authority in accordance with the other provisions of the Mutual Recognition Act 1992. 4. Licences covered by this declaration are licences that are issued to natural persons, not licences issued to companies. 5. This declaration and any subsequent declarations will be reviewed for accuracy periodically. The licence equivalence information contained in the updated declarations will be made available on the Licence Recognition website (www.licencerecognition.gov.au) and the websites of the relevant licensing authorities.
