DECLARATION OF AN APPROVED WILDLIFE TRADE MANAGEMENT PLAN -
MANAGEMENT OF COMMERCIAL HARVESTING OF FLORA
IN WESTERN AUSTRALIA 2023-2028
I, Belinda Jago, Branch Head, Oceans and Wildlife Branch, as Delegate of the Minister for the Environment and Water declare under subsection 303FO(2) of the Environment Protection and Biodiversity Conservation Act 1999, that the Management of Commercial Harvesting of Flora in Western Australia 2023-2028 plan, prepared by the Western Australian Department of Biodiversity, Conservations and Attractions, is an approved Wildlife Trade Management Plan for the purposes of section 303FO of the EPBC Act.
Unless amended or revoked, this declaration has effect subject to the following conditions applied under section S303FT:
1. The commercial harvest for export of endemic and non-endemic flora in Western Australia must be undertaken in accordance with the Wildlife Trade Management Plan for the Management of Commercial Harvesting of Flora in Western Australia 2023 –2028.
Flora species authorised for commercial harvest are contained in the Export Flora List (Appendix A).
2. The Western Australian Department of Biodiversity, Conservation and Attractions must have written approval from the Department of Climate Change, Energy, the Environment and Water to add species to the Export Flora List.
3. The Western Australian Department of Biodiversity, Conservation and Attractions must supply an updated Export Flora List to the Department of Climate Change, Energy, the Environment and Water within 48 hours of a species addition or removal.
4. This declaration is valid for five years from the date after its registration on the Federal Register of Legislation.
5. The Western Australian Department of Biodiversity, Conservation and Attractions must submit an annual report to the Department of Climate Change, Energy, the Environment and Water by 1 May each year, covering the harvest of endemic Western Australian flora in the previous year.
The annual report must include details of:
1) The number of licences granted to support commercial harvesting, by licence type and as a yearly comparison.
2) A summary of harvesting, by species, including:
a) harvest locations
b) harvest type (artificially propagated or wild harvested)
c) harvest quantity and flora parts taken.
3) A summary of compliance management and enforcement activities, including:
a) the number of inspections conducted at flora dealer premises
b) the number of field inspections conducted
c) the number and type of potential offences detected and investigated
d) any enforcement action taken.
4) A summary of completed environmental monitoring and adaptive management measures implemented to address identified sustainability risks.
6. The Western Australian Department of Biodiversity, Conservation and Attractions must provide the Department of Climate Change, Energy, the Environment and Water with the published results of all research it has undertaken in relation to the commercial harvesting of endemic Western Australian flora.

A person whose interests are affected by this declaration may, within 28 days, make an application in writing to the Department of Climate Change, Energy, the Environment and Water for the reasons for the decision.
An application for independent review of the decision (under section 303GJ(1) of the Environment Protection and Biodiversity Conservation Act 1999) may be made to the Administrative Appeals Tribunal (AAT), on payment of the relevant fee (currently $1,826 or reduced fee where applicable due to financial hardship) by the applicant, either within 28 days of receipt of the reasons for the decision, or within 28 days of this declaration if reasons for the decision are not sought. Applications should be made to the Deputy Registrar, AAT in your Capital City.
