1 This is an application by the Australian Liquor, Hospitality and Miscellaneous Workers Union, New South Wales (ALHMWU) for variation of the Newcastle University Union Food and Beverage Staff (State) Award 1997 (308 IG149) ('the Award') in accordance with the State Wage Case 2002 ('SWC 2002) [2002] NSWIRComm 118. 2 The application in this matter was filed on 14 June 2002 and subject to hearing on 24 June 2002. Mr J Barry appeared on behalf of the ALHMWU. Mr J Broughton appeared on behalf of the Newcastle University Union ('the University Union') with Mr P Blackford. 3 Mr Barry tendered an amended Schedule A (exhibit 1) putting that the amended variation is by consent of the parties. 4 Mr Barry submitted that the variation complied with relevant legislation and the principles enunciated in the State Wage Case 2002. 5 Mr Broughton enunciated the consent of the University Union to the variation sought. 6 I am satisfied that the variation as put by the ALHMWU (exhibit 1) meets the requirements of the State Wage Case 2002. . 7 The Award is appropriately varied in the terms of exhibit 1, the variation sought by the ALHMWU, with effect from the first full pay period to commence on or after 20 July 2002.
